Terms of Use

These Terms of Use (“Terms”) govern your use of the Formutate mobile application (“the App”), provided by Formutate. By downloading, installing or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for personal or internal business purposes, in accordance with these Terms and with Google Play’s terms of service.

2. What you may not do

• Reverse engineer, decompile or disassemble the App, except where that restriction is prohibited by applicable law
• Redistribute, sell, rent, sublicense or lease the App
• Use the App to process content you do not have the legal right to process
• Use the App to infringe copyright, circumvent technical protection measures, or break any applicable law
• Interfere with the App’s advertising, or attempt to defeat, obscure or automate interaction with the ads that fund it
• Use automated means to interact with the App at scale

3. Your content

You retain all rights to the files you convert. We claim no ownership over them and, as described in our Privacy Policy, we never receive them — all conversion happens on your device.

You are solely responsible for ensuring you have the right to convert any file you select, and for the lawfulness of the content you process.

4. Advertising

The App is provided free of charge and is funded by advertising served through Google AdMob. By using the App you accept that ads will be displayed. We do not control and are not responsible for the content of third-party advertisements or the sites they lead to.

5. Intellectual property

The App, its name, logo, design, and all associated content are owned by Formutate and protected by intellectual property law. Nothing in these Terms transfers any of those rights to you.

The App includes third-party open-source components, each governed by its own licence. Those licences continue to apply to their respective components.

6. Availability and changes

We may modify, suspend or discontinue the App or any feature at any time, with or without notice. We may also update these Terms; material changes take effect when the updated Terms are posted with a new “Last updated” date. Continuing to use the App after that means you accept the change.

7. Disclaimer of warranties

The App is provided “as is” and “as available”, without warranty of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that conversions will be accurate, complete, or that formatting will be preserved. See the Disclaimer for detail on conversion accuracy and its limits.

8. Limitation of liability

To the maximum extent permitted by law, Formutate shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, files, profits, revenue or goodwill, arising out of or relating to your use of the App — even if we have been advised of the possibility of such damages.

Because the App is provided free of charge, our total aggregate liability to you for all claims relating to the App shall not exceed USD 10.00.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. Where that is the case, the above exclusions apply only to the extent permitted, and nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud.

9. Indemnity

You agree to indemnify and hold harmless Formutate from any claim or demand, including reasonable legal fees, arising out of your misuse of the App or your breach of these Terms or of any law or third-party right.

10. Termination

These Terms remain in effect until terminated. You may terminate at any time by uninstalling the App. We may terminate or suspend your licence immediately if you breach these Terms. Sections 5, 7, 8 and 9 survive termination.

11. Your local law

Nothing in these Terms deprives you of the protection of mandatory consumer-protection law in your country of residence, or of any right you have under it that cannot be waived by agreement.
